Christopher Carroll called the meeting to order at 7pm by commencing the pledge of allegiance.

Normand Berube Builders, Inc. have submitted a sketch plan of a proposed eleven lot subdivision located off Narragansett Trail, Tax Map 6, Lot 38; in the Business/Commercial District.
        Bill Thompson of BH2M presented the plan for an 11-lot single family dwelling subdivision, located on a 40-acre parcel presently owned by David Fogg.  The parcel is wooded in back with a field in the front.  It sits in the Business/Commercial district, which requires a conditional use permit along with the subdivision request.  The boundary survey depicting the 40-acres is complete. There is a stream on the westerly side and the wetland mapping will be protected in the rear.  One roadway is proposed coming off of Route 202/Narragansett Trail; it being 1275 feet long with all lots accessed by this road.  The lots will be no smaller than 80,000 with a 40,000 sq. ft. minimum buildable area, as calculated on the plan.  Each lot will have individual well and septic system. No other soils test have been done at this time, other than what is associated with the wetland mapping.   A fire storage tank will also be included once we meet with the Fire Chief and agree an area that will best serve the town.  Will build the road to the new proposed town standards and propose as a town road in the future.  This pre-application was submitted on December 31st, 2014, along with the application and per lot fees.  There is another 75-acre parcel on the opposite side of Route 202 also owned by David Fogg.   He has spoken to Mr. Thompsons  client, but no plan at this time.  Mr. Thompson plans to work through the final engineering reports and come back in a couple months when it will be better for a site walk.  

Questions from the Board:
        Chad questions if there will be a substantial buffer between George Sawyer Road and the subdivision.   Bill Thompson added that there will be natural vegetation along the road (Route 202), but the plan does not show as far as George Sawyer Road, so he is not sure.  The existing farm house will be removed.  All driveway access will be off of the proposed road, no lots will be accessed from Route 202.  Bill Thompson did not know what price value range the dwellings would be in.
Jere notices on the plan it states “No DEP Review” and “not within the special flood hazard zone”,   but on the back is indicates it is within the 500 foot boundary.  Bill Thompson explains that it’s the 100 year flood zone that the town deals with, he has illustrated the 500 year boundary (Zone B) adding that this does not come into play under our flood zone.  It’s all outside of the developed area of this parcel.  Jere lists a few requirements that are required to be submitted; stormwater design, fire tank location and plan, buildable area, etc…  The road is staked out if you want to check it out, but they will wait and return in March.  
The density only allows eleven (11) lots, and the lots cannot be split.  There is no common space.  There will be a homeowners association/road maintenance agreement for the road initially, but only until the town takes over the road. The Board reiterates the importance of following the new road ordinance.

  • Motion by Mark to approve the minutes of November 10, 2014, seconded by Chris B.  the motion passed with a 4 - 0 -2, Jere and Chris B. abstained.

Other Business:
        ~Treasurers report for 2015/2016 Budget
                Larry Curtis proposes the 2015/2016 budget to the Board.   We are still at 7 member board, but will decreased down to 5 members in July.  The rest of the budget is already pared down as far as it can.  Due to the increase of applications, more site walks, meetings and workshops.  Recommending to maintain the same budget for 2015/2016 for a total of $7,400.  Based on next year’s salaries budget could be decreased by approx. 30%.  

~Review for proposed Article 12 Road Acceptance Regulations:  Cliff Emery and Tom Kennie
The Board has had a chance to review the proposed ordinance amendments.  Department Head Tom Kennie agrees with the proposal.  The Planning Board Chair was opposed to one section of the proposed ordinance, has this been amended.  Not at this time.  The Selectmen would like to have one public hearing together with the Planning Board.   
  • Motioned by Jere, seconded by Mark to schedule a public hearing for Monday, February 9th 2015 at 7pm.  A unanimous vote.
~Review Fire Protection Ordinance:  Due to other commitments the Fire Chief rescheduled for the January 26, 2015 meeting.
~Review findings of facts for Zaremba Group, LLC (Dollar General):  The Board agrees to hold the findings until the meeting of the 26th.  The Board is requesting a letter from the Fire Chief stating that the developer has meet the conditions of Article 8.2.b.8 and any other applicable sections of the ordinance.

Attendees may address the Board on the evening’s business:  
                Linda Townsend attended the meeting in August or September 2014, where she voiced her concerns about the well at 50 Pennell Road.  A two hundred year old farm house.  She says that the Board had said nothing would be done, somebody would come in and check the well and the house before anything was done on that property.  Jere informed Ms. Townsend that it only pertains to blasting.  Ms. Townsend continues “They have built a new road, dumped a bunch of dirt, and drilled a well.  Now all that comes out is sludge, the well is gone.  The well driller is telling me I have to prove that the well was deep enough, in order for them to do something about my well is drained, based on this new construction. There is water for three days on and then about a week off.  They are hauling water for the tenant.  I have an issue with this and there needs to be some accountability.”  The well is 250 to 300 feet deep, because the pump is in the well and if you pull it out you can walk to the end of Pennell Road.  Ms. Townsend did find out the center of the proposed detention pond is only 250 feet from her well, and wonders how they can build this when her well is dried up.   Christopher Carroll suggests contacting a geologist and a lawyer.   No water quality was tested before the well was dug.  Jere explained that this is a civil matter and there is nothing that the Board or the Town can do.  The protocol is to inspect before “any blasting” not before well drilling.   The Board continues further conversation with Ms. Townsend.

Motioned by Mark to adjourn at 7:38 pm, seconded by Chris B, a unanimous vote.
